Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the Burrak AI platform, websites, APIs, and related services (collectively, the "Services") provided by Burrak AI ("Burrak AI", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.

2. Eligibility and accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Services. You are responsible for the information you provide when registering and for keeping your account credentials secure.

You are responsible for all activity that occurs under your account, including actions taken by autonomous agents you configure. Notify us promptly of any unauthorized use of your account.

3. Use of the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business or personal purposes.

You agree not to:

• Use the Services in violation of any applicable law or regulation.
• Reverse engineer, decompile, or attempt to extract the source code of the Services, except where permitted by law.
• Interfere with, disrupt, or place an unreasonable load on the Services or supporting infrastructure.
• Use the Services to build a competing product, or to train competing models, without our written permission.
• Use autonomous agents to perform actions that are illegal, harmful, deceptive, or that infringe the rights of others.

4. AI agents and generated output

The Services let you create and run autonomous agents that plan, call tools, and act across connected systems. You are responsible for the tasks you assign to agents, the permissions and credentials you grant them, and for reviewing their output before relying on it.

AI-generated output may be inaccurate, incomplete, or unsuitable for your purpose. The Services are not a substitute for professional advice. You should independently verify any output before acting on it in production or other high-stakes contexts.

5. Customer content

You retain ownership of the data, prompts, instructions, and other materials you submit to the Services ("Customer Content"). You grant us a worldwide, royalty-free license to host, process, and transmit Customer Content solely as needed to provide and improve the Services and as described in our Privacy Policy.

You represent that you have the necessary rights to submit Customer Content and that doing so does not violate any law or third-party right.

6. Fees and payment

Paid plans are billed in advance on a recurring basis according to the pricing in effect when you subscribe. Unless stated otherwise, fees are exclusive of taxes, which you are responsible for paying. Refunds, where applicable, are governed by our Refund Policy.

7. Intellectual property

The Services, including all software, models, designs, and trademarks, are owned by Burrak AI or our licensors and are protected by intellectual property laws. Except for the limited license granted to you, these Terms do not transfer any rights in the Services to you.

8. Third-party services

The Services may integrate with or depend on third-party tools, APIs, and platforms. We are not responsible for the availability, accuracy, or conduct of third-party services, and your use of them may be subject to their own terms.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, or error-free.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BURRAK AI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure for us, or if we discontinue the Services. Upon termination, your right to use the Services ends, and provisions that by their nature should survive will survive.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Services or by other reasonable means. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
